Article 1 (Service Agreement)
This Agreement shall apply whenever an un-T　Records　Home Page user uses the un-T　Records　Home Page information distribution service (hereinafter referred to as "the un-T　Records　Home Page") provided by un-T　factory inc (hereinafter referred to as "the Company").

Article 2 (Scope of this Agreement)
1. The various regulations announced by the Company to the Users of the un-T　Records　Home Page (hereinafter referred to as “the Users”) from time to time shall constitute part of this Agreement, and the Users shall agree to these regulations.
2. The rules of use of the various services provided by the Company in the un-T　Records　Home Page shall also constitute part of this Agreement, and the Users shall agree to these rules.

Article 3 (Modification of this Agreement)
1. The Company shall be able to modify this Agreement from time to time without obtaining the consent of the Users, and the Users shall agree to such modifications.
2. The modifications of this Agreement prescribed in the preceding paragraph shall be considered as being acknowledged by all Users after the notice on such modifications is displayed in the un-T　Records　Home Page for one (1) month.

Article 4 (Notice from the Company)
1. In addition to cases prescribed in the preceding Article, the Company shall notify necessary matters to the Users from time to time when it deems it necessary to do so.
2. The notices prescribed in the preceding paragraph shall be considered to have been given to all Members when they are displayed in the un-T　 Records　Home Page.

Article 5 (Service Hours)
In principle, the un-T　Records　Home Page shall be available twenty-four (24) hours a day . However, the service may be temporarily suspended for regular maintenance and other reasons.

Article 6 (Private Information on Members)
Information that is necessary for the use of the un-T　Records　Home Page, such as a User’s address, telephone number, and status of the un-T 　Records　Home Page use, shall be registered in the Company's database as private information. The Company shall manage such registered information as private information and shall not disclose such information to third parties except in the following cases:
(1) If the consent of the User concerned is obtained;
(2) If the Company is required by laws and regulations to disclose such information;
(3) If such information is disclosed in a condition in which it cannot be identified as private information

Article 7 (Prohibition of Non-private Use)
1. Except when approved by the Company (including the approval granted by the Company to a third party who is entitled to the information concerned), Users shall not be allowed to reproduce, sell, publish, or use any information obtained through the un-T　Records　Home Pagefor other non-private purposes.
2. Users shall not be allowed to force third parties to perform acts that are contrary to the provision set forth in the preceding paragraph.

Article 8 (Prohibition of Commercial Activities)
Except when approved by the Company, Users shall not be allowed to conduct sales activities using the un-T　Records　Home Page, use the home page for commercial purposes, or utilize it to prepare for its commercial use.

Article 9 (Non-guarantee of the Content of the un-T　Records　Home Page) The Company shall not be responsible for giving any guarantee to Users concerning the information provided by the Company and Users through the un-T　Records　Home Page.

Article 10 (Temporary Suspension of Service)
1. If one of the events specified below occurs, the Company may temporarily suspend the un-T　Records　Home Pagewithout giving advance notice to Users.
(1) If the un-T　Records　Home Pagesystem undergoes regular or emergency maintenance
(2) If the Company is unable to provide the un-T　Records　Home Pagedue to fire, power failure, or other accidents;
(3) If the Company is unable to provide the un-T　Records　Home Pagedue to earthquake, volcanic eruption, flood, tidal wave, or other natural disaster;
(4) If the Company is unable to provide the un-T　Records　Home Pagedue to war, disturbances, riots, upheavals, labor disputes, or other incidents;
(5) If the Company deems it necessary to suspend the un-T　Records　Home Pagefor operational or technical reasons.
2. Even if the Company suspends, is delayed in providing, or is otherwise unable to provide, the un-T　Records　Home Pagefor reasons other than those specified in the preceding items, it shall not be held responsible for any damage that Users or third parties may suffer from such delays, suspensions, or other incidents.

Article 11 (Facilities)
Users shall prepare, at their own expense and responsibility, communications equipment, communications lines, software, and all other incidental facilities that are necessary to use the un-T　Records　Home Page. In addition, Users shall maintain their own terminal in a normal condition so that it may not hinder the service provided by the un-T　 Records　Home Page.

Article 12 (Prohibited Acts)
1. Users must not perform any of the acts specified below on the un-T　 Records　Home Page.
(1) The act of violating the copyright or other intellectual property rights of other Users, third parties, or the Company;
(2) The act of infringing on the property, privacy, or other rights of other Users, third parties, or the Company;
(3) The act of slandering or libeling other Users, third parties, or the Company;
(4) The act of conducting pre-election, election, or other similar campaigns;
(5) The act of transmitting harmful computer programs and other types of software to, or writing such programs in, the un-T　Records　Home Page; (6) The act of giving disadvantages to third parties;
(7) An act aimed at conducting commercial activities using the un-T　 Records　Home Page;
(8) The act of disturbing public order or good customs;
(9) An act that may lead to criminal acts;
(10) The act of using fictitious email address, or impersonating a third person or an organization.
(11) An act of providing misleading credit card and other information. (12) Other acts that run counter to laws and regulations.
2. If a User causes damage to a third party when he/she uses the un-T　 Records　Home Page, the User must settle the problem at his/her own responsibility and expense and shall not cause trouble or damage to the Company.
3. The Company shall take no responsibility for any damage caused to a User because he/she uses the un-T　Records　Home Pageand shall have no obligation to compensate for such damage.
4. If a User causes damage to the Company in violation of this Article, the Company shall be entitled to claim compensation for such damage to the User.

Article 13 (Exclusive Agreed Jurisdiction)
If the necessity of a lawsuit arises between the Company and a User, both parties shall agree to submit to the exclusive jurisdiction of the Tokyo District Court.
Additional Rule This Agreement will come into effect on May 24. 2006
